I did not put my true name because I fear Judge Brooks would take what I have to say and allow it to influence his decision in any cases I may have in front of him. Let me assure you of one thing, Judge Brooks was recently reversed on appeal twice in one family law case. That is because he failed to follow the law. In that case, Judge Brooks even failed to admit the exhibits used at trial into evidence despite giving a final judgment. I have never ever seen any judge fail to do that. If you were to ask any attorney how to even respond to such an issue, I guarantee they would tell you they don't know because they have never seen that happen before. If you read the transcript in that case, it took one of the attorneys to remind Judge Brooks that he could not consider any of the exhibits used as evidence at the trial in making his decision to which Judge Brooks admitted was true. Despite Judge Brooks setting an additional trial date solely for the purpose of admitting the exhibits into evidence, he still failed to make a ruling on admitting the exhibits to trial after that extra hearing date set just for that purpose. Yet he later handed down a final judgment that was reversed on appeal by stipulation by both parties. Meaning, the party that prevailed, and with all of the odds of wining the appeal on his side, later agreed to reversing the entire judgment, which is rare. Even after Judge Brooks' judgment was reversed, and the case was returned to him as the trial judge, he again made an incredibly wrong ruling, that resulted in an emergency motion to the appellate court. The appellate court not long after gave a ruling that either Judge Brooks change his ruling, or provide another reason in support of his prior ruling. If he failed to do either, the court would reverse him again. Once alerted to the appellate court's ruling, he quickly changed his ruling 180 degrees.
Now I have read where people in support of Judge Brooks have stated their distrust of this website because the critics here do not have to give their true names. Although that is a very valid point, I can assure you that this review here is the truth, and if the public wants to research the facts set forth here, they will find they are true. In fact, I can offer you one more example of how incredibly had his judgement was in this particular case. But before I do, I think people such as me who have seen this Judge make incredibly bad rulings are legitimately afraid to put their names on even valid criticism of him. The fear being he will allow his knowledge of the criticism to affect his rulings when they involve cases involving those who have criticized him. Now on to the further information regarding his poor ruling in this family law case.
One of the reasons his judgment was reversed is that he handed the wife in this divorce a large sanction award based on allegations against her attorney by the opposing party. This is what went down exactly. As I stated above, Judge Brooks had failed to rule on admitting the exhibits used at trial into evidence. He was alerted to this fact by the wife's attorney on what should have been the last day of trial. Since he made this oversight, he was forced to set an additional day for trial for the sole purpose of admitting the exhibits into evidence. Yet on that day, the husband's attorney showed up with a motion for sanctions, which had not been served on the other side, and he took it under submission without providing the other party the opportunity to be heard. Basically, he violated her due process rights because he later handed down a sanction award. The sanction statue specifically states that a sanction "shall be imposed only after notice to the party against who the sanction is proposed to be imposed and an opportunity for that party to be heard." It is clear and well known language in that statute, which is Family Code section 271.
But that is not the only problem with that incredibly wrong ruling. He also handed down such a large award, it would have impoverished the wife, and in this case, she would have been forced to leave this country, and return to England without her children. His ruling not only hurt the wife, but it also would have hurt the children of both parties unless it was reversed. Under section 271, it also specifically states "the court shall not impose a sanction pursuant to this section that imposes an unreasonable financial burden on the party against who the sanction is imposed." The amount of the award Judge Brooks provided would have put the wife, who was a stay at home mother during the entire 15 year marriage, into bankruptcy. Does that sound like a Judge who is knowledgeable of the laws he is being asked to apply?
Judge Brooks likes to point to the Third District Appellate justices as his supporters, which I find odd considering he was just reversed twice this year in one case by those justices. Maybe they offered their support to him before making these rulings. Either way, I think this case alone is compelling proof that Judge Brooks is not suited to be a judge.
I went to court with my daughter to get a restraining order against her ex who has a criminal record. We had evidence of him making threatening comments. He did not issue the restraining order because he said we did not have sufficient evidence. I feel bad for all the women who have to go in front of this ignorant judge. I believe he needs to get some education on criminals. He should take the time to really hear the people who are in front of him. When we have a judge like this he really puts all of are lives in danger. We moved here from San jose thinking we would be better of in a small town. So sad because Eldorado county is so beautiful but this judge makes it ugly.
It seems very convenient that most if not all of the positive reviews for Judge Brooks are within the last few months (when he knew he would soon face the voters). The negative reviews span the near entirety of his term.
It would appear to me that Judge Brooks is trying to fool the voters of El Dorado County by having his supporters write in on the 11th hour of his 6 year term.
Don't let him mislead you about his record. I would say the most objective reviews on here, pro or con, are the ones that pre date the political season. All of those reviews are bad ones.
Let's vote him out and if Tiemann is just as bad let his reviews doom him in 6 years.
If i was Roland Tiemann i would demand for a recount. It seams a little fishy that Nelson Brooks won the election. And if you went to the candidate meeting he was clearly clueless of the law. How can 60% of the voters vote for him. Just remember God is watching the currupt ones you will have your day.
I sat in Judge Brooks court on Feb 15, 2013 and watch with horror how he allow himself to be dupe by an ex con, master scam artist and a three times ex con. The plea from the victims asking protection from the courts against the ex con for harassment and threats fell on death ears.
Judge Brooks may be a good human being with all the right intentions; however, he continues to demonstrate poor listing skills to Plaintiffs with legitimate requests for protection. This judge is tying the hands of lawenforcment by denying them the legal tools to enforce civil harassments and criminal threat laws en act by our law makers.
Some one is going to get hurt by one those criminals that Judge Brooks has side with and ruled in their favor.
My daughter and i had to move because of this incompetent judge. Her ex-boy friend kept harrasing her. Judge Nelson keith Brooks did not give us a restraining order. You cannot imagine what we went thrue it was such a nightmare. The sheriff even said we needed a restraining order. I will say that the sheriffs in El dorado county are the best. As soon as we moved we got a restraining order right away. The judge in Danville knew what he was doing. I would like to tell the voters please dont vote for this judge.
Nelson Keith Brooks is running for re-election in El Dorado County, California. Despite the endorsement of the local newspaper, the Mountain Democrat, he is not qualified for the office. His court room policy of NOT granting first time incidents of violence or violent threats to victims seeking restraining orders, regardless of the severity or nature of the violent threat, prejudice the already reluctant and timid petitioners before they even walk into his court room. Needless to say, Judge Brooks policy are contrary to California state law. I would advise anyone interested in finding out more about the truth, to review court transcripts as to his decisions. Judge Brooks decisions should be scrutinized by his peers, as well as the court of public opinion.
I will be voting for Roland Tiemann and would hope the voters do to. Roland Tiemanns practice area is criminal law he will make an excellent judge. Nelson keith brooks is not qualified for the job. I would not vote for a judge that does not take the opinion of the lawenforcement. The police and the sheriffs are out making our world a safe place for all. El dorado county needs a judge that will be tough on crime.
He does not read anything you present to him. He continues to make erratic rulings with no consistency. He has been very biased against women and keeping young children with their mothers. He has not had any regard for keeping women and children safe and has been quick to listen to uncaring men.
Nelson Keith Brooks needs to be removed from his seat. He does not care to listen to the citizens that are in his court. He puts lives in serious danger. He is only there for the big paycheck. He could careless for the hardworking Americans that he puts in danger.
I found Judge Nelson Brooks to be both biased and purposefully slanderous with remarks he made in judgment of a case I carefully prepared and brought before him. His remarks were so far out of line and inaccurate that one could only assume he attempted revenge on behalf of another. This Judge is not fit to serve the public as a Superior Court Judge.
I have read the pros and cons about judge Nelson Brooks. I attended two candidate meets and was not impressed at all.
He was not prepared, easily confused, was quite cocky by trying to point out that his opponent Roland Tiemann was incorrect.
That really made him appear to be the smaller person in the debate....as HE was the one not answering questions correctly.
He does seem like a really nice guy - I see why longtime friends praise him for being a good man.
However, because he can even take the time to be prepared for speeches and the law during his election - he certainly will not get my vote.
I expect more for my tax dollars. Mr. Tiemann clearly knows the law and I found his answers to be right on the money. Very impressive .
I attended a candidate meeting and was surprised that Nelson Brooks who has been a judge for six years did not know the law. He was not prepared seamed confused at times. He made many mistakes. I hope the voters saw what i did a judge that does not know the law. If he shows up to a candidate meeting unprepared thats what he is going to do in court. My vote is for Roland Tiemann he knows the law and was prepared.

Unfortunately, the most flagrant characterization being spread on this website is the rumor that Judge Brooks and..."Mr Briggs bought up a lot of land in El Dorado county and want to sell it for a pretty penny." This is a complete falsehood. Judge Brooks owns no land in the vicinity of the proposed court house site, and has never been in any partnership with any member of the Briggs family. Furthermore all Superior Court Judges are called upon to make hard decisions regarding the litigants who appear before them. Inevitably one side wins and one side loses. It is not uncommon for the losing side to believe the decision was in error, even though the judges decision strictly follows the law.
El Dorado County is privileged to have Judge Brooks and smart voters will re-elect him in the upcoming election.
A few years ago my friend was taken back to court by his wife. She was seeking more money for child support, as well as, more time with her kids. My friend is a hard-working business man who loves and supports his kids. Unfortunately his free time is limited and he is not able to be there personally for his kids. His ex-wife is a good Mom who had become a little greedy and did
not want to share the kids at all. Judge Brooks weighed all this very carefully. While I was in his courtroom he treated everyone respectfully including my friend and his slightly over emotional wife. Judge Brooks had obviously prepared for the case. He asked questions t;hat were appropriated and informed. Judge Brooks kept the courtroom quiet and respectful while the big life questions were being decided. Its' interesting, because even though he decided against my friend and gave his ex wife more money and she was made the main caregiver in terms of time, my friend was a man of principle. He was sad, but did not feel he was asked to pay more money than he could afford. He felt he had has day in court and if he had to go back again he wanted Judge Brooks as his Judge. The two attorneys who represented my friend and his wife played a part in keeping these life changing matters calm and reasonable. If I ever have to go before a judge to help make my family life decisions I hope it is someone as calm and knowledgeable as Judge Nelson Brooks
I have known Judge Brooks for over 16 years, when our daughters met in Kindergarten and became fast friends. He is one of the most independent-thinking people I have ever known. I have observed him gathering information and deliberating so that he can make the best decision. I know he carries this deliberative style into his courtroom. I have seen him leave dinner parties, so that he could return to the office to read all submitted documents for an upcoming case. Clearly the negative opinions expressed on this website are from people who did not get the decision from him that they desired. Perhaps if they took a minute to think, they would realize that they lost a case because either (1) they were on the wrong side of the law, or (2) they failed to provide the documentation needed for Judge Brooks to rule in their favor. It is not the judge's fault that necessary information was not provided for consideration. El Dorado County is privileged to have Judge Brooks.
In our family's court room experience with Judge Brooks, he was very fair, logical, and considered each person's circumstance carefully. He clearly had reviewed all documentation submitted and made a decision that was in the best interest for all involved. If we ever needed to be in a court again and had a choice for a judge, it would be Judge Keith Brooks.
Wow, some of the garbage that is spewed by the above comments is truly ridiculous. I do understand that there are 2 sides to each argument and often times the side that doesn't "win" or have the judge decide in their favor finds themselves "cheated" by a dishonest or lazy judge. Judge Brooks is neither. In fact, in the 40+ years I have known him, I have found him to be one of the most honorable, honest, and ethical men I have ever had the pleasure of knowing. He is analytical, intelligent, and I am certain that he would never issue a decision without thoroughly researching the law(s) for the particular case at hand. Regarding his move from family law, it was at the request of the presiding judge in EDC, due to a quandry that she found herself in due to the performance of the judge that Judge Brooks replaced. He is an exemplary example of what a judge should be. (I have lived in EDC for all but a few years since 1974 - both sides of the hill - and follow the judicial rulings and court cases with great interest).
Judge Brooks helped me and my mother through a very difficult time. He was a true gentleman in the courtroom and listened to our case very closely. He looked at all the facts although he awarded custody of my little boy to my mother he awarded me generous visitation and helped my see what I needed to do to regain custody
I wanted to reply to all these false reviews on Judge Brooks. I have known him now for over 17 years and I have lived in El dorado Co. since 1986. I have coached many Basketball and Soccer teams with him when our sons were a little younger and saw the compassion ,empathy and motivation skills he had. There is not a more smart ,fair and highly ethical/law following person I know . In addition hi is unbiased and a tireless detail oriented/researcher. He was that way (and sucessfull) as an attorney and he is more so now. He routinely gets to his office at 3:30 am to be as prepared as possible for all his up coming cases. We El dorado Co. residents are lucky to have a Superior Court Judge so dedicated. Vote to keep the Honerable Nelson Keith Brooks as Superior Court Judge!
My relative recently appeared before Judge Brooks. The Judge treated him with dignity even though he was guilty and had admitted it. Judge Brooks was calm but held him accountable and decided upon a fair course of action to hopefully get him back on the right track
I have known Judge Nelson "Keith" Brooks for over 15 years. He is one of the most dedicated judges that I know and surely among the most knowledgeable in the judicial system. It is not uncommon for Judge Brooks to get up at 3am-4am in the morning, read his daily Briefs, review the relevant case law... all before ever going to Court. It is rare, if not impossible, for either the Defendent's or the Plantiff's attorney(s) to pull the wool over his eyes. That last time he was up for reelection, over 70% of El Dorado County's voters voted for him. His current opponent barely has enough years as an attorney to even run for Judge. Do you want and experienced, dedicated and well-read Judge on the bench deciding your case or a newbee Judge? My vote is for Judge Nelson "Keith" Brooks.
Voters, if you want the most honest person sitting on the bench then vote for Judge Brooks. These negative comments are a bunch of garbage. I have had the pleasure and honor to have worked with Judge Brooks. You will not find a more dedicated man. Judge Brooks truly cares about keeping the citizens of El Dorado County safe. El Dorado County needs Judge Brooks.
I grew up in El dorado county and i can say that in the last five years crime here has gone out of control. Growing up here we never locked our doors now we lock our doors with a gun near bye. The sheriff department work night and day to keep the crooks away.We need a judge that will put these criminal's in jail and off of our streets. Vote for Roland tiemann to keep El dorado county safe again.
I have been in court 2 times in the past 5 months. Judge Brooks is the most compassionate and humble Judge I have ever worked with. He is very respectful and does a great job helping people get through some of the most difficult times of their life. Any negative review on this site is beyond ridiculous. This is basically Yelp but for Judges, but actually less monitored then Yelp. Judge Brooks is an outstanding Judge and his peers would back that up.
I whole-heartedly support the re-election effort by K. Nelson Brooks for Superior Court Judge. I met his family about 15 years ago when he was coaching my son's football team. I saw his personality traits come through as he calmly and fairly dealt with young teenagers AND their parents. He impressed me then, and has ever since. I want our community to know that he is, and has always been a gentleman. This quality alone is one that is not as pervasive as it should be. His Honor is a compassionate, honest, and fair man who displays a dedication to serving our community-- not solely by loyalty to family and friends, but by displaying a loyalty and devotion to the citizens of El Dorado County. He continually displays a commitment to service as one of our Superior Court Justices. I have had an opportunity to observe his court room as he sat on the bench while several cases were presented. My observation was that he was incredibly fair and decisive with each case that was presented. We need the K. Nelson Brooks to continue as our Superior Court Judge. El Dorado County deserves a gentleman such as His Honor to deliver unbiased, fair, yet appropriate justice to protect the citizens he serves. Personally I believe voting for K. Nelson Brooks is a win/win decision for all of us, and our families.

My friend was in family Court and it went to trial, she was pro per. Judge Brooks was fair and impartial. He took all evidence into consideration and examined what would truly be best for all involved. My friends custody time went down, yet she was very happy with the outcome. If she ever needs to go to court again she wants Judge Brooks, because she knows all parties involved will be treated fairly.
Unfortunately, this forum appears to be more recently focused on the election coming up in El Dorado County. That being said, I am happy to convey my thoughts on Judge Brooks. He is highly qualified, and I personally know of many instances when he has provided fair and impartial guidance for the parties that have appeared in his court. Compared to his opponent in the current election, Roland Tiemann, Judge Brooks is far superior in his knowledge of the law, and his application of fair legal outcomes. I received a Roland Tiemann political ad in the mail. I have to say that he and his advisors have systematically distorted facts and made a feeble attempt to manipulate voters in this election. Judge Brooks is clearly the most qualified person for this position, and I, like many of my friends know fact from fiction, and are not easily swayed by the lack of substantive arguments that Roland Tiemann has presented in his smear campaign toward Judge Brooks. Mr. Tiemann has only been a practicing attorney for 10 years. Not near enough time to really understand the legal principles that will be required as a Superior Court Judge.
I have known Judge Nelson Brooks for over 25 years. He is a very steady hard working man with an even handed approach to his cases. He studies very hard and reviews his cases thoroughly so that he is familiar with the law surrounding the cases. He is an experienced judge with a good background for this position. I trust and admire his work ethic and know he will continue to do a great job.
Although I do not know Judge Brooks personally I have checked references and editorials and, without question, he seems to have demonstrated the experience and qualifications to retain this important position of Superior Court Judge, El Dorado County.

Judge Brooks is the kind of judge we need in today's society--one who is decisive, practical, knowledgeable, respected, conscientious, experienced, trustworthy, tough, has a broad spectrum of legal and life-related knowledge and one who will help protect innocent people and hold criminals to the letter of the law. We need to retain judges like Judge Brooks in our court system and our community!
Although not a personal friend I am acquainted with Judge Brooks and his performance in Eldorado County. I have sought opinions regarding Judge Brooks bench performance from local attorneys in the D.A.s office as well as the public defenders office. Attorneys in both positions strongly endorsed Judge Brook's performance. I find support from both the prosecutorial and defense positions an endorsement in itself.
I found judge Brook to be tolerant, easy going, and reasonably fair. Of all of the judges I've appeared before he has been the best. I cannot say or evaluate his knowledge of the law, at the time it was certainly better than mine, but he's not full of himself like many are and he's not a fascist like many of the "liberal" appointees. He is, like most, more concerned with meeting his department performance goals than real justice - but that's pretty normal in California. Unlike most judges, he was not biased against pro per litigants. With about 60% of litigants appearing pro per, and that number increasing, my guess is that this judge will be around for awhile.
